Terms of Service – ZmPay®

1. Introduction
ZmPay® is operated by ZmSolutions L.L.C (Headquarters – France). These Terms govern your use of our website, payment gateway, and related services (collectively, the “Services”). By using ZmPay®, you agree to comply with these Terms, our Legal Notice, and any applicable policies. If you do not agree, do not use ZmPay®.

2. Services Provided
ZmPay® provides payment processing, merchant services, and settlement management for businesses. Services are offered “as-is” and “as-available.” While we strive for uptime and reliability, we do not guarantee uninterrupted service.

3. Eligibility & Registration
– You must provide accurate and current information when registering.
– By using ZmPay®, you authorize us to process, transfer, and store payment-related data as required by law and financial regulations.
– ZmPay® may request verification documents to meet anti-fraud, AML, and KYC requirements.

4. Fees & Charges
– All payments are prepaid. Fees are communicated transparently and confirmed before enforcement.
– Certain fees may be finalized after your first transaction to ensure accuracy.
– Prepaid fees are non-refundable, except where required by law (see Refund Policy).

5. Acceptable Use & Prohibited Activities
You agree not to use ZmPay® for unlawful, fraudulent, or prohibited purposes, including but not limited to:
– Illegal substances, equipment, or counterfeit goods
– Pirated or unlicensed content
– Fake identification or documents
– Hate speech or violence-promoting content
– Scams, deceptive schemes, or predatory services
– Any other activity deemed unethical or unlawful by ZmPay®

6. Security & Account Responsibility
– You are responsible for maintaining the security of your account and login credentials.
– Notify ZmPay® immediately if you suspect unauthorized access.
– ZmPay® uses industry-standard security measures but cannot guarantee full protection against all external threats.

7. Risk & Service Restrictions
– ZmPay® reserves the right to hold, delay, or restrict transactions if suspicious or high-risk activity is detected.
– Funds may be withheld or accounts suspended for regulatory or compliance reasons.
– ZmPay® is not liable for losses unless you can prove full compliance with laws and these Terms.

8. Limitation of Liability & Indemnification
– ZmPay® is not responsible for losses due to misuse, unauthorized access, or third-party issues.
– You agree to indemnify and hold ZmPay® harmless against claims, damages, or legal actions arising from your use of the Services.

9. Third-Party Services
– ZmPay® may integrate or interact with third-party services. You must comply with any terms related to those services.

10. Termination
– ZmPay® may suspend or terminate access at any time for fraud, violations, or regulatory concerns without prior notice to protect service integrity.

11. Changes to Terms
– ZmPay® may revise these Terms at any time. Updates will be posted on our website or sent via email. Continued use means you accept the updated Terms.

12. Governing Law
– These Terms are governed by the laws of France and the European Union, subject to the jurisdiction of French and EU courts.
